Yes, you can sue but it does not make sense. It is like asking that if someone was assaulted by someone who used a Bauer Hockey stick, would they sue Bauer? No. Bauer sold that stick somewhere and the attacker bought it most likely from a retailer. Bauer did nothing wrong.
